fall under the general order guidelines The Shearwater Group, Inc. Price Quotations All price quotations for our products must be issued by an authorized Shearwater Sales Channel. This channels can be identified by visiting our "Contact Us" page. All quotations are effective for a period of 10 days from the date of issue, even if not marked as to expiration date. All transactions are quoted in United States Dollars, with payment in United States Dollars and are not subject to any alteration due to currency exchange rate or valuation of any kind. All quotation prices are quoted as Net United States Dollars, and do not include any consideration for state, local, international excise, or VAT tax. Prices are quoted as the net amount payable to The Shearwater Group, Inc., unless otherwise stated in the quotation. Internet Shipments and Taxation
"While there is no specific tax exemption for sales made over the internet, some of your internet sales may not be subject to tax. For example, the sale of electronic data products is generally not taxable when products are electronically transferred to your customers, whether over the internet, by modem, or by other electronic means. However, if as a part of the sale you provide your customer in California with tangible personal property - such as a hard copy of the electronically transferred information or a copy on a physical storage medium such as a CD ROM or diskette - your sale of the electronic product may be taxable." **Our software is strictly shipped over the internet without any tangible products or copies following. Payment Terms Net 30 days. Payment can be made by either U.S. Domestic Check or by domestic or international wire transfer. Freight All software keys and license agreements are shipped via internet and constitute the billable items of any purchase. Any hardcopy media shipped to the customer is prepaid, with freight billed to the customer. Hardware is shipped second day delivery prepaid and billed, unless otherwise specified on the purchase order. Important Notice to Purchasers of Our Products Software Purchases. The actual purchased and billable items for any software license purchase are the software license and the software permission keys. The software license agreement and software permission keys are digital data and are always shipped via the internet. Software object code without authorization key is supplied to the User by Internet Download at no charge. For shipments to Users within the United States, internet transactions are excluded by federal law from tax and may not be subject to state and local taxes. The Shearwater Group, Inc. makes no claims as to the tax exempt status of any software license sale, and recommends that all Users determine the appropriate tax status of any transaction by contacting the appropriate taxing authority. Hardcopy media of any kind, including software manuals, tapes, CD medias are shipped when requested without charge except for freight and handling and are not considered part of the billable transaction of a license purchase. Software Maintenance. The actual purchased and billable items for any software maintenance purchase are the software maintenance agreement and the software permission keys if applicable. These two items are digital data and are always shipped via the internet.
